The Designer Collection Terms & Conditions

By renting our garments from The Designer Collection, you agree and consent to these terms and conditions. 

We reserve the right to alter/add to our terms and conditions as we see fit. Prices and discounts are subject to change at any time without notice.

This website is operated by The Designer Collection. Throughout the contract, the terms 'We' 'Us' and 'Our' refer to The Designer Collection. 

The contract between the renter and The Designer Collection commences when the payment is received by The Designer Collection for the rental. The Designer Collection has the right to refuse service to anyone at any point without explanation. The rental period is the period of time that has been allocated for the hire of the garment. 

Failure to comply with any of the following terms and conditions will be dealt with accordingly. 

Please remember we are a rental company therefore, garments should not be expected to be in brand new condition. There will always be an element of wear to these dresses including but not limited to micro pulls, small loose threads, knicks to threads or the shaping of boning in our garments. We do our best to make note of any significant wear and tear in our garment descriptions. We are more than happy to provide additional photos and descriptions of any imperfections noted in our garment descriptions. In the event that there has been significant condition changes to your garment prior to your event, we will notify you of this.

1. Rental Agreement

When you hire with The Designer Collection, you agree to hire our garments for a set period of time, as set out in our terms and conditions. Only you, the renter is able to wear your hired garment and therefore, it is not to be shared around while in your possession. You solely hold the responsibility for the garment during your rental period. If any damage and/or claims are made against you as a result of occurrences that happened when the garment was in your possession, regardless of whether they were your own doing or not, you will be held accountable.

The rental is for the period of time that has been agreed upon by The Designer Collection and the renter. The Designer Collection is the legal owner of all the garments set out in our collection, therefore, all rentals must be returned the following working day, unless agreed otherwise. 

All prices listed on our site are in New Zealand Dollars (NZD) and will not be hired outside of New Zealand. 

If you are under 18 years of age, your parent or legal guardian must agree to this contract. This states in summary, that we will hold you accountable to uphold the rental agreement.

We do not hold items prior to payment being received.

2. Garment arrival time

The Designer Collection only ships Monday - Friday, as per NZ Post's network which does not operate on weekends. The only exception being Saturday delivery, which must be selected at checkout if you are booking past our postal cut off (Wednesday 1pm).

Our garments are typically posted 2-4 days prior to your selected date, unless the circumstances of a late order. For weekend orders, we aim to have all of our garments sent by Wednesday afternoon at the latest. We will contact our customers in the event there is a disruption to their parcel being sent out 2-4 days prior to their event. 

All of our parcels are sent with NZ Post on overnight courier.

If you are needing your garment during the day or days prior to your selected event (e.g you are travelling early to your event) please make us aware of this prior to placing your booking. The date you book your garment for must be the date you are wearing the garment, please do not book for the date you are wanting the dress to arrive or the date you are travelling as this will affect your return date. We will not issue a refund if your garment does not arrive prior to the date you have selected, unless we have been notified of this prior to placing your booking.

Extended rentals can be booked for special events for extra security and to ensure you receive your item earlier than your selected date.

Postal rentals must be made by Wednesday 1pm each week for weekend arrivals. Bookings created after Wednesday 1pm for that weekend must select Saturday delivery. 

Please note all postal orders made less than 3 full working days prior to the rental start date or after the Wednesday 1pm postal cut off are made at the renters own risk of not arriving. These are considered late bookings.

If you have selected pick up, you will receive an email 1-3 days prior to your event notifying you of the times you may pick your garment up. Please monitor your emails, both your primary inbox and junk box for your pick up notification. If you are unable to pick your item up within our allocated time slots, please respond to the email as soon as possible to arrange a different day/time.

3. Rental date selection

Please book your garment for the date you are wearing the garment, this includes extended rentals.

We are not responsible for when an item has been incorrectly booked for the wrong date.  

4. Damage

You will be liable for any damage you cause to the garment, including but not limited to, cigarette burns, stains and rips. If the repairs affect any future bookings of the garment you will also be liable to fulfil these payments, as this impacts both the next customer and the nature of our business. If any garment is returned beyond repair, you will be liable for the full replacement fees. The replacement fee is to be determined by The Designer Collection as the RRP or the price to replace the dress at the current time of repurchase. Replacement fee payments must be made within 30 days of your rental date, however, we are more than happy to discuss payment plans. Under no circumstances will this result in allowing you to keep the garment. 

Light staining that is able to be removed by The Designer Collection will not be subject for any additional fees. For items that are returned with significant marks/staining that are not able to be removed by us personally, will be subject to extra dry cleaning charges. Upon dry cleaning, you will be sent the receipt and an invoice to pay within 24 hours. Failure to comply with payment will result in a professional matter. 

We reserve the right to select the dry cleaner/repair service. The charge will be determined by the selected outlet and The Designer Collection. We agree to be entirely fair when selecting the dry cleaner/repair service and will be transparent with arrangements and communication. 

Please note, any silk or delicate garments may be subject to heavier cleaning fees. 

All damages or staining made before your rental period, will not be deemed your fault and will be taken note of when the garment is returned. Should any damage or staining occur prior to your booking, we will make the renter aware of this.

Any repairs/alterations to a garment must be approved by The Designer Collection prior to the garment being repaired/altered. This must be completed by a professional seamstress and a receipt must be emailed to us. If any alterations/repairs are completed without are knowledge and approval, we reserve the right to collect payment for damage and/or replacement of the garment.

5. Cleaning procedures 

All items are cleaned thoroughly by us between rentals. Depending on care labels, garments are either carefully hand washed or dry cleaned. Please do not attempt to clean the dress yourself, if any fading or wear to the garment happens as a result of this, you will be liable to pay the full replacement fee.

6. Unpaid Fees and Theft

If you, the renter fails to pay the charges outlined by The Designer Collection, you authorise The Designer Collection to seek compensation for up to 150% of the RRP of the garment. Should any bookings need to be cancelled in the event that theft or late returns have occurred, you will be liable to fulfil these payments.

The Designer Collection reserves the right to take all necessary steps to receive the qualified payments, such as legal action and debt collection. Methods can include but are not limited to debt collection agencies, disputes tribunal, legal action, naming you publicly. 

Renters who breach their contract, waive their rights to their information being kept private. Should we need to seek compensation or a stolen garment of ours, details provided in your booking may be used. 

Renters are required to cover all debt collection fees (for Baycorp debt collection this surcharge is an added 25% of the original debt owed).

All late fees, loss of income or damage invoices have a 7 day due date, unless agreed upon otherwise. 

Should a customer have an outstanding invoice with The Designer Collection and place a new order with us, we reserve the right to cancel your order. We also reserve the right to keep the new orders payment as compensation for the outstanding debt. 

7. Issues upon receiving a rental

If you believe your garment has arrived in an inadequate condition with notable marks/stains/damage, please let us know immediately. Your item must be sent back within 24 hours of receiving your garment and remain unworn for your event. Once returned we will assess the situation and determine compensation that is suitable. Choosing to wear an item to your event or keeping it for longer than 24 hours are receiving it declares that you accept the garment in this condition and waive the right to a refund. There are no other cases where rentals will be refunded. 

Partial refunds may be offered if a garment is received in a wearable condition but with an unlisted flaw beyond scope of normal/expected rental wear. Please contact us within 24 hours of receiving your item if you believe your garment has arrived with a defect that we have not pre-listed. We will assess the situation and determine compensation that is suitable.

We do not offer swaps in the event you change your mind or if the item does not fit as once a booking is placed it holds the garment from availability to other customers. Please understand we have also undergone the process to complete the rental, which includes our time, cleaning and packaging. We also typically cannot get rentals rebooked for the same date at such late notice. Swap outs may however be available for pick up orders. If you have a pick up order which you wish to swap please ensure you notify us within 12 hours of collecting your order.

Please carefully read our product descriptions as refunds are not offered for change of mind or if the item does not fit.

Try ons are based in St Albans, Christchurch and are encouraged to ensure you are happy with the fit of the garment before renting. If you are based outside of Christchurch and would like further sizing information, please contact us via email.

8. Item descriptions 

Items with flaws or imperfections we know about will be stated in the listing description. No refunds will be offered if your garment arrives with an imperfection which is outlined in the listing description as these have been acknowledged before renting. If you require photos of the imperfections or flaws, please contact us via email as we are more than happy to provide photos on request.

Label size and recommended sizing differ from one another. The label size will always be the size on the label attached to the garment, whereas recommended sizing is based off what we recommend as the best fit for the garment. We are not liable if the recommended size is not entirely accurate for you. 

Please remember we are a dress hire company and a lot of our dresses are worn on a weekly basis, therefore, items should not be expected to be in brand new condition. We do however acknowledge that our dresses must be in a wearable condition with minimal damage and staining. Expected wear and tear is considered as: 

  • Micro pulls
  • Small loose threads
  • Stitching knicks
  • Small or unobvious markings
  • Shaping of boning in our garments

9. Refunds

Please note that a refund will not be provided due to change of mind or if the garment does not fit you correctly. Refunds will not be issued if you fail to provide us with the correct shipping address or details. Once you place your order, the order cannot be cancelled. Please ensure to carefully read through our measurements and descriptions of the garments. Parcels with tracking showing 'attempted delivery', 'ready for courier' and/or 'redirection requested' are not applicable for refunds. We recommend that you contact NZ Post to arrange a depot collection if the parcel has been attempted for delivery or has spent an extended amount of time awaiting courier collection. Redelivery or redirection will cause delays.

10. Shipping

Postal Rentals

Postal rentals must be made by Wednesday 1pm each week for weekend arrivals. Bookings created after Wednesday 1pm for that weekend must select Saturday delivery. 

Please note all postal orders made less than 3 full working days prior to the rental start date or after the Wednesday 1pm postal cut off are made at the renters own risk of not arriving. These are considered late bookings.

Late bookings placed after Wednesday 1pm for weekend bookings or less than 3 full working days prior to the rental start date will not receive a product refund or shipping refund if the garment does not arrive on time.

Postal rentals must be returned by 4pm the next working day. If you fail to return your garment by the following working day then you will incur a $20.00 late fee per each day it is not returned. If sending back your garment later than 5pm the following working day affects any future bookings of the garment you will also be liable to fulfil these payments, as this impacts both the next customer and the nature of our business.

If the rental is being sent by post to return to The Designer Collection, shipping must be carefully read and followed (as per the return cards sent with your order). Postal rentals must be dropped to a NZ Post outlet. No drop boxes are to be used as our parcels need to be scanned, failure to do so may result in additional charges. If sending your garment back incorrectly affects any future bookings of the garment you will also be liable to fulfil these payments, as this impacts both the next customer and the nature of our business.

If you happen to lose the return bag, you must contact us immediately to arrange an alternative option. You are liable to pay for any extra postage costs as a result of this.

Please understand, that once the item has entered the NZ Post network, The Designer Collection is no longer responsible for any shipping delays that may occur.

We use overnight tracked postage New Zealand wide and ship as early as we can, aiming for you to receive your garment 1-3 days prior to your selected date. You will receive a tracking number via email when your item has been packaged by us. Please monitor your tracking number carefully via the NZ Post website, and should any shipping delays occur, contact NZ Post urgently. When contacting NZ Post, we advise that sometimes depot pick ups can be arranged if the item has reached your local depot however, this is at your responsibility. Please understand we are not liable for any communications held between the renter and NZ Post however, we do endeavour to assist where we can, should you need any further information from our end.

We, The Designer Collection are not responsible for any delays in shipping, attempted deliveries, misdirects or postal faults caused by NZ Post. It is your responsibility to be available for delivery of your garment or collection of your item/s at the post office. The Designer Collection takes no responsibility for lost or stolen items. Please understand that when renting with The Designer Collection, there is always an associated risk, particularly when you are choosing for us to ship the item via NZ Post as a seperate contractor that your item may not arrive by your selected date. We do not offer refunds in the event that your item does not arrive by your selected date however, we will compensate this by issuing you a store credit to the product amount, minus shipping costs. 

Please ensure you enter your shipping address correctly, any updates to your shipping address must be made 24 hours prior to your item being sent out. If your shipping address is rural and 'non-rural' shipping has been selected at checkout, you will be invoiced the difference. This payment must be made prior to your item being collected by the courier.

11. Pick Up and Drop Off

You are able to select the alternative method of pick up and drop off in Christchurch. This feature will be available at check out and is free of charge. You are required to drop back the garment on the following calendar day after your selected date. Failure to do so will result in a $20.00 fee per day. The Designer Collection is not responsible for any lost or stolen goods. You will be liable for the full RRP if the garment is lost, stolen or not returned. 

We are not responsible for when an item has incorrectly been selected as pick up instead of shipping. We do not provide product or shipping refunds if this is to occur. Please ensure you carefully read the shipping information at checkout and if you are in doubt, get in contact with us.

12. Extended Rental Selection

If you select the extended rental option, your rental period will be up to 6 calendar days from the day you have selected to wear the garment. The item must be returned on the 6th calendar day, unless agreed otherwise by The Designer Collection and the renter. If you are planning to take your garment outside of New Zealand, this will need to be discussed prior to your booking. You agree that during your extended rental selection, you are solely responsible for the garment and should it be misplaced, lot or damaged, you will be liable for the charges outlined by The Designer Collection.

13. Sizing

The Designer Collection endeavours to help you where possible with the fit of our garments. The size and recommended size is stated under the description of the garment. While we provide recommended sizing for each garment, please note we are not held accountable if the item does not fit on arrival. Please do your due diligence and find the measurements online or alternatively contact us if you require extra assistance with the sizing of a garment. 14. Wear

Please be extra cautious when wearing our garments and treat them as your own. If possible avoid any situations where smoking is present and do not attempt to try clean the garment if there is spillage on it. Please do not wear the garment with freshly applied fake tan, as this can leave permanent stains which you will be liable for.

Please remember we are a dress hire company and a lot of our dresses are worn on a weekly basis, therefore, items should not be expected to be in brand new condition. We do however acknowledge that our dresses must be in a wearable condition with minimal damage and staining. 

Please do not attempt to wash or dry clean the garment yourself as some of our items are delicate and require special dry cleaning/hand washing. Once we receive the garment back, we will look over the dress and determine the cost of cleaning, if any. Light staining that is able to be removed by The Designer Collection will not be subject for any additional fees. For items that are returned with significant marks/staining that are not able to be removed by us personally, will be subject to extra dry cleaning charges. Upon dry cleaning, you will be sent the receipt and an invoice to pay within 24 hours. Failure to comply with payments may result in legal action.

15. Return Cards

When receiving your garment please carefully read through your return card as it contains important information regarding the return of your garment. Failure to follow the instructions set out on your return card may result in additional charges.

16. Bulk rentals & gift cards

Bulk rentals are bound to the same terms & conditions as standard rentals. 

Should an item be returned late without contacting us and for a justifiable reason, you risk waiving the rights to your outstanding subscription.

Bulk rentals are subject to garment availability and exclude our sale items.

Postage costs are not included within the bulk rental package cost, if you require shipping please select this per item booked. Pick ups are free of charge.

Bulk rentals and gift cards are non-refundable.

17. Order modifications

Orders can be modified prior to postage or pick up. This can be to the garment itself or the rental period dates. Please contact us to do so.

If a customer changes garments and the new garment is of a higher rental fee, the difference is required to be paid in order to confirm the modification to the booking. If a customer changes garments to another of a lesser value, the customer will receive the difference in store credit. Refunds will not be issued under any circumstance. 

18. Modifications to our website/service

We reserve the right to alter/add to our terms and conditions as we see fit. Prices and discounts are subject to change at any time without notice. 

We reserve the right at any time to modify or discontinue the service (or any part or content thereof) without notice. 

We shall not be liable to you or any third party for any modification, price change, suspension or discontinuance of the service.

 

19. Ex rentals 

All purchases of ex rentals are final. These cannot be returned or exchanged. 

We will clearly outline the condition of the garment for sale and whether it has any defects. 

Ex rentals cannot be purchased with gift cards, store credit or discounts. 

20. COVID-19 Information 

Any orders that are affected by COVID-19 will be given a full store credit, including any shipping costs that have been paid. These store credits can be used to re-book any garment and will not expire. If you have any further queries regarding this topic, please don't hesitate to get in contact.
